Cebu Port Authority General Manager Francisco “Kit” Comendador III files an administrative complaint against Cebu City Mayor Michael Rama before the Office of the President for the mayor’s role in the “forcible entry” by City Hall officials into CPA’s Baseport Area on April 1, 2024.
The complaint pertains to Mayor Rama’s alleged violation of Administrative Order No. 23 series of 1992 which prescribes the rules and procedures on the investigation of administrative disciplinary cases against elected officials of LGUs.
“Mao ning among gipasaka sa Office of the President para dili na gyod mausab. Mao nay among dinaliang hangyo nga dili na samokon pag-usab ang atoang kagamhanan sa Cebu Port Authority,” GM Comendador said.
The complaint specifies the mayor’s purported violations of Rule 2 Section 1 (c) Dishonesty, oppression, misconduct in office, gross negligence, or dereliction of duty; (e) abuse of authority;
which could be grounds for discipline, suspension, or removal from office.
The CPA’s move came weeks after some officials and personnel of Cebu City Hall went to the port area and reportedly installed rail fences to block the entrance to the CPA’s port extension project located across the Compania Maritima.
Such acts, according to the CPA, comprise an “impermissible encroachment into the territorial jurisdiction of CPA” and a “deliberate and flagrant disregard of CPA’s authority, and obstinate disobedience and resistance” to the writ of preliminary injunction granted by the Regional Trial Court Branch 10 in CPA’s favor.
Personnel of the Department of the Interior and Local Government in Central Visayas (DILG 7) received the complaint. | SN
