The Cebu Provincial Board allowed the Cebu City Traffic Operations Management (Citom) temporary use of a portion of the provincial property along Gov. Cuenco Ave. in Banilad, Cebu City.
The resolution, authored by 3rd district Board Member Grecilda P. Sanchez and approved in mass motion on Monday, Sept. 8, authorized Gov. Hilario P. Davide III to enter into a memorandum of understanding (MOU) with Citom for the temporary use of the lot with an area of 351 sq. m. as loading and unloading bay for public utility jeepneys.
Among the requirements stated in the resolution are that Citom shall shoulder all expenses for the temporary use of the specific portion of the property and in accordance with its needs and requirements; maintenance and upkeep of the said portion shall be the responsibility of Citom; the property shall be used exclusively for the above-mentioned specific purpose; and the demolition of whatever structure constructed thereon during the effectivity of the MOU shall be the responsibility and expense of the office.
It also stipulates that Citom will undertake to remove or cause to remove at its own cost any pole, signage and the like on the subject area and vacate the same without need of formal or judicial demand, upon notice to vacate is served.
The MOU does not transform the area into a usufruct, lease or any other form of encumbrance or disposition by the province over the said property and shall be effective upon signing and remain in force and effect until terminated by any of the parties at will.
