Capitol looks into ejectment case against Apas residents

_IGP0431The provincial government is following closely the ejectment case involving 157 families of Sitio San Miguel, Barangay Apas, Cebu City.

This after the residents filed an urgent motion for issuance of preliminary injunction with temporary restraining order against the demolition order of the Municipal Trial Court in Cities.

The petition alleged that the lots they are occupying are owned by the province and not by complainant-appellee Aletha Suyco-Magat.

For this reason, Governor Hilario P. Davide III said the province made a special appearance in the hearing of the case yesterday, Monday.

In a meeting with the residents of Barangay Apas and their lawyer, Governor Davide learned that the land title of Suyco-Magat is a reconstituted title.

“Meaning, diha’y title niana sauna, na wala tungod sa war or something, or na sunog ba, then gipa-reconstitute,” he said.

The governor confirmed that the Capitol has a photocopy of a title, which named the province of Cebu as the owner. “We are now studying the case if we can establish ownership on the said property,”Davide said.

In an earlier interview, Apas Barangay Captain RamilAyumanasked the Capitol to intervene in the said case. But the Capitol is not a party to the case. Xerxes Alkuino
